What Stays With the House?

During a real estate transaction, sometimes people don't think about exactly what they're getting with the house. Are you selling your home but you want to make sure you keep grandma's drapes? Did you find the perfect house to buy that has that beautiful chandelier in the entrance-way that you've always wanted? No matter which side you're on, make sure that the contract states exactly what you get to keep.

According to Florida law, anything that is permanently attached to the structure of the house is usually part of the sale. This includes major appliances like stoves, dishwashers, refrigerators, washers and dryers, as well as light fixtures, ceiling fans, carpeting, and drapes.

If you're a seller and you want to guarantee that something specific comes with you, you can specify it into the contract. However, you would be amazed how often a little detail like "who keeps that ceiling fan" can cause challenges for a deal. That's why I recommend that if you want to keep something, make sure you remove it from the house before you even put it on the market. This will prevent problems from occurring down the road. Better safe than sorry.

If you're buying a home and you feel particularly attached to anything, make sure to read through the contract to be sure that it comes with the sale. If you can't find the answer in the contract, don't be afraid to ask. Don't assume anything.
